1. Introduction

These Terms and Conditions govern the provision of building inspection services by New Building Inspections (ABN: 47601429183), located in Victoria, Australia.
By booking an inspection, paying for it, or allowing access to the inspection site, you agree to these Terms.
2. Definitions

Client: The individual or company who books and pays for the inspection.

Inspection: A visual, non-invasive inspection of the property as agreed in the quote.

Report: The written document provided after the inspection.
3. Services
New Building Inspections provides inspections in accordance with the scope and stage agreed upon in the booking or quote, including but not limited to:

Pre-Slab Inspection
-
Slab & Frame Inspection
-
Pre-Plaster Inspection
-
Fixing & Waterproofing Inspection
-
Final & Pre-Handover Inspection
Inspections are visual only. No invasive, destructive or technical testing (unless otherwise stated in the quote).
4. Booking & Payment
4.1 Booking Confirmation
A booking is confirmed once you receive a written confirmation and payment has been made in full (unless otherwise agreed).

4.2 Payment Terms
Payment must be received prior to the inspection. Quotes are valid for 30 days.

4.3 Service Fees
Quoted fees may vary based on site access, additional locations, or special requirements, and may incur extra charges.
5. Cancellation & Refunds
5.1 Cancellation by Client
You may cancel up to 48 hours before the scheduled inspection for a full refund.
Cancellations within 48 hours may incur a fee equal to 50% of the inspection cost (to cover administration and time).
No refund if cancellation is on the day of inspection.

5.2 Cancellation by Inspector
If an inspection cannot proceed due to unsafe conditions, weather, or lack of access, we may reschedule at no extra cost.

5.3 Refunds
Once an inspection has commenced or a report has been issued, no refunds apply.
6. Site Access & Safety
6.1 Access
Client must ensure safe and legal access to the site at the scheduled time.
If access is denied or unsafe, inspection may be cancelled and full fees charged.

6.2 Safety
Inspectors may refuse or terminate an inspection if site conditions are unsafe.
7. Report Limitations
7.1 Non-Invasive
Inspections are visual only and do not include invasive testing, destructive analysis, specialist reports, or compliance guarantees.

7.2 Information Only
Reports are for informational purposes only. New Building Inspections is not responsible for future defects or hidden issues not visible during the inspection.

7.3 Third Party Use
Reports provided to one party may not be relied upon by others.
8. Liability
To the fullest extent permitted by law (including the Australian Consumer Law and Building Act 1993 (VIC)):

Our liability for any loss, damage, injury or claim is limited to the amount paid for the inspection.

We are not liable for indirect, consequential, financial or loss-of-use damages.
9. Privacy
We collect personal information necessary for bookings, reporting, and communication.

10. Governing Law
These Terms and Conditions are governed by the laws of the State of Victoria, Australia, and any dispute shall be resolved in Victorian courts.
11. Changes to Terms
New Building Inspections may update these Terms and Conditions at any time without notice.
